The above captioned matter was heard
as a contested case on August 12, 1986, at which time the complainants and
respondent appeared. The hearing was
continued until September 2, 1986, at which time the complainants and
respondent again appeared and presented testimony, exhibits and argument on the
complaint.
After consideration of the entire
record the following facts are found:

The respondent is a public agency within the meaning of §1-18a(a), G.S.
2.
By letter dated June 23, 1986 the complainants made a request of the
respondent for the following information concerning the Greater Bridgeport
Resource Recovery Project:
a. how much money of the project is
attributable to the demolition of Bridgeport I;
b. how much money is attributable to the
Shelton landfill;
c. what portion of the tipping fees is for
transportation and operation of the transfer stations;
d. what portion of the tipping fees is for
ash disposal and estimated by-pass landfill; and
e. a copy of the annual financial
projections on the estimated revenues and expenses for the operation of the
plant.

From the denial of access to the requested information, the complainants
appealed to the Commission by complaint filed on July 21, 1986.

It is found that the records identified in paragraphs 2a, 2c and 2d,
above, are not in the possession of the respondent, but are retained by Signal
Corporation, a private entity that manages the project.
5.
With respect to paragraph 2b, above, the respondent provided the
complainants with a copy of the document containing that information.
6.
With respect to paragraph 2e, above, the respondent provided the
complainants with a copy of the document at a previous hearing held on August
12, 1986.
The following order by the Commission
is hereby recommended on the basis of the record concerning the above-captioned
complaint:
1.
The complaint is hereby dismissed.
