The above captioned matter was
scheduled for hearing September 11, 1986.
At that time both parties appeared and presented evidence and argument
on the complaint.
After consideration of the entire
record the following facts are found:
1. The respondent is a public agency
within the meaning of 1-18a(a), G.S.
2. By complaint filed July 28, 1986, the
complainants alleged they were denied records relating to various components of
a promotional exam which had been given by the respondent.
3. The records had been requested by
letter on July, 11, 1986, and they were denied on July 16, 1986.
4. The respondents claimed the records
were exempt under 1-19(b)(6) because they consist of test questions,
scoring keys, or other examination data used to administer an examination for
employment.
5. The records which were withheld consist
of:
(1) questions and answers for, and
tapes of an oral exam given by experts from outside the department;
(2) questions and model answers for
an essay exam, criteria for grading the exam, and the blue books of individuals
who took the exam;
(3) questions and answers for, and
tapes of an oral exam given by the police commission.

6. It is found that the records requested
by the complainants are exempt under 1-19(b)(6), G.S.
The following order by the
commission is hereby recommended on the basis of the record concerning the
above captioned complaint.
1. The complaint is hereby dismissed.
