The above-captioned matter was heard as a contested case on May 12, 1988, at which time the complainants and the respondents appeared and presented testimony, exhibits and argument on the complaint. At such time the respondents moved to dismiss the complaint based upon the complainants' alleged failure to allege a violation of the Freedom of Information Act. Following a discussion among the parties the complainants agreed to withdraw their complaint.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

1. The complaint is hereby dismissed.
