The above-captioned matter was scheduled for hearing as a
contested case on January 17, 1989, at which time the parties appeared and
presented argument on the complaint.
After consideration of the entire record, the following
facts are found:
1. The
respondents are public agencies within the meaning of §1-18a(a), G.S.
2. On
November 23, 1988, the complainant filed a complaint which alleged that on
November 16, 1988, the respondent chairperson held an illegal meeting because
less than a quorum was present.
3. The
respondents moved to dismiss the complaint for failure to state a claim upon
which relief can be granted.
4. It is
found that the complainant did fail to state a complaint upon which relief can
be granted.
The following order by the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint:
1. The complaint
is hereby dismissed.
