The above-captioned matter was heard as a contested case
on January 20, 1989, at which time the parties appeared and presented evidence
and argument on the complaint.
After consideration of the entire record, the following
facts are found:
1. The
respondents are public agencies within the meaning of §1-18a(a), G.S.
2. On
October 11, 1988, the complainant requested a copy of the file of the
respondents concerning the disappearance of William F. Grant, Jr. on or about
May 18, 1988.
3. On
November 15, 1988, the respondents denied the complainant access to the
requested copy.
4. On
December 1, 1988, the complainant filed his complaint with the Commission.
5. The
respondents claim the file is exempt pursuant to §§29-170 and 29-171, G.S.
6. It is
found that the state-wide organized crime investigative task force maintains
the file, No. S-88-00102-4, which is
the subject of the complainant's request.
7. It is
concluded, therefore, that the records in the file are exempt from disclosure
pursuant to §§29-270 and 29-171, G.S.

The following order by the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint:
1. The
complaint is hereby dismissed.
