The above-captioned matter was heard as a contested case on February 28, 1989, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. During the hearing, the parties stipulated to the following settlement:

1. The respondent will provide the complainant an opportunity to view his requested inmate file, not including two items of correspondence withdrawn from that file by the respondent, for approximately one hour by the end of March 1, 1989.

2. The respondent will provide the complainant copies of the complainant's requested inmate file, not including two items of correspondence withdrawn from that file by the respondent, by March 6, 1989, with the expense of copying to be borne by the complainant's representative, Barbara Deaz.

3. The complainant will withdraw his complaint.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1. The complaint is hereby dismissed.
