The above-captioned matter was heard as a contested case
on June 26, 1989, at which time the complainant and the respondent appeared,
stipulated to certain facts and presented testimony, exhibits and argument on
the complaint.
On the basis of the evidence presented at the June 26,
1989 hearing, the hearing officer determined that there was insufficient
evidence upon which to support reasonable findings and a recommended
order. Prior to reopening the hearing
for the gathering of further evidence, however, the complainant formally
withdrew his complaint.
The following order by the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint:
1. The complaint
is hereby dismissed.
