The above-captioned matter was heard as a contested case
on September 28, 1989. Despite the fact
that the opening time of the hearing was extended for one hour as a courtesy to
both parties to enable them to appear, both the complainant and the respondent
failed to so appear.
The following order by the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint:
1. The complaint is
hereby dismissed for failure to prosecute.
2. The Commission
notes that the unexcused failure of the parties to appear resulted in the waste
of public resources. In addition, the
Commission believes that the refusal of the respondent's attorney to appear
jeopardized the interests of the respondent and reflected poorly on the people
of Norwich.
