The above-captioned matter was scheduled as a contested case on October 3, 1989, at which time the complainant and the reapondent appeared and presented testimony, evidence, and argument on the complaint.
At hearing Henry E. Buermeyer moved that he be granted intervenor status. The motion was denied by the hearing officer.
After consideration of the entire record, the following facts are found and conclusions of law are reached:
1. The respondent is a public agency within the meaning of 1-18a(a), G.S.
2. By complaint filed with the Commission on June 5, 1989, the complainant alleged that the respondent held an improper special meeting on May 12, 1989 without an agenda and minutes.
3. It is found that the respondent did produce minutes of the May 12, 1989 special meeting.
4. It is found that 1-21, G.S. does not require that an agency provide an agenda for a special meeting; rather an agency must list the items of business which it will transact on its notice of special meeting.
5. It is found that the notice provided for the special meeting on May 12, 1989 contained a list of the items of business which the respondent transacted at its May 12, 1989 meeting.
6. It is concluded that the respondent did not violate the requirements of 1-21(a), G.S., when it did not produce an agenda for its May 12, 1989 meeting.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.
1. The complaint is hereby dismissed.
