The above-captioned matter was scheduled for hearing as a
contested case on August 7, 1989, at which time the complainant and the
respondent appeared and presented evidence and argument on the complaint.
After consideration of the entire record, the following
facts are found:
1. The
respondent is a public agency within the meaning of §1-18a(a), G.S.
2. By letter
of complaint filed June 23, 1989, the complainant alleged that he was denied
access to files of the respondent which pertained to parking tickets issued
within the last twenty-four months, and by an amendment to his complaint
requested that a civil penalty be imposed upon the respondent.
3. At
hearing the respondent agreed to permit access to the files.
4. It is
found that under the circumstances of this case a civil penalty is not
appropriate.
The following order by the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint.
1. The
complaint is hereby dismissed.
