The above-captioned matter was heard as a contested case
on October 4, 1989, at which time the complainant and the respondents appeared,
stipulated to certain facts and presented testimony and argument on the
complaint.
At the hearing, Beverly Hills Concepts, Inc. requested
and was granted intervenor status.
On the basis of the evidence presented, the undersigned
hearing officer found probable cause to believe that the respondents will
violate §§1-18a and 1-21, G.S., and therefore, pursuant to §1-21i(b), G.S.,
ordered that the respondents not reconvene a hearing in the matter until the
Commission decides this case.
1. After the
hearing, the respondents agreed to comply with the complainant's request.
The following order of the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint:
