By
agreement of the parties the above-captioned matter was scheduled for hearing
November 27, 1989, at which time the complainant and the respondent appeared
and presented testimony and argument on the complaint.
After
consideration of the entire record, the following facts are found and
conclusions of law are reached.
1. The respondent is a public agency
within the meaning of 1-18a(a), G.S.
2. On May 25, 1989, the complainant
requested copies of rules and regulations regarding procurement of outside
financial advice systems, and professional consultants, such as auditors,
accountants, attorneys, computer specialists and system specialists as well as
information regarding consultant contracts and minority consultant contracts.
3. By complaint filed June 19, 1989, the
complainant alleged that the respondent had not complied with his request.
4. It is found that the respondent does
not have the requested records.
The
following order by the Commission is hereby recommended on the basis of the
record concerning the above-captioned complaint.
1. The complaint is hereby dismissed.
