The above-captioned matter was heard as a contested case on June 25, 1990, at which time the complainant and the respondent appeared.
1. It is found that the complainant made his request for records to the respondent on February 2, 1990 and that the request was denied on February 6, 1990.
2. It is found that the complainant filed his appeal to this Commission on March 13, 1990 by letter postmarked March 9, 1990, more than thirty days after the February 6, 1990 denial.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed for lack of subject- matter jurisdiction.
