The above-captioned matter was heard as a contested case on December 4, 1990, at which time the complainant and the respondent appeared, stipulated to certain facts and reached an agreement concerning the complaint.
The parties agreed that the respondent had violated the Freedom of Information Act by taking an improper vote to approve the Brandy Acres II subdivision by telephone on July 25, 1990. On November 27, 1990, the respondent voted to declare null and void its approval of the Brandy Acres II subdivision on the grounds that the vote was improperly taken. The respondent agreed that its members would attend a workshop on the Freedom of Information Act when such a workshop was scheduled in their area.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.
1. The complaint is hereby dismissed.
