The above-captioned matter was heard as a contested case on May 13, 1991, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.
In the course of the hearing, the respondents provided the complainant with the records he had requested, consisting of a police officer's complete personnel file, the civilian complaint file against the officer, two related arrest reports, and a printout of the officer's performance who was the subject of the civilian complaint. The complainant then withdrew his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed.
