The above-captioned matter was scheduled to be, and was, heard as a contested case on November 30, 1992 at 10:00 a.m. However, at that date and time neither the complainant nor the respondent appeared. Instead, at 9:39 a.m. the Commission received by facsimile a stipulated agreement stating that the parties had reached an agreement and would not be in attendance at the hearing.
The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:
1. The complaint is hereby dismissed with prejudice.
2. The parties' failure to notify the Commission of their settlement until twenty-one minutes before the scheduled hearing resulted in the unnecessary expenditure of state taxpayer funds by the Commission at a time when such funds are especially scarce. The Commission reprimands those responsible for their inexcusable conduct in this regard.
