The above-captioned matter was scheduled to be heard as a contested case on February 17, 1993, at which time neither the complainant nor the respondent appeared.
Immediately following the scheduled hearing, the Commission received by hand delivery a letter dated February 11, 1993 from the respondent indicating that the parties had entered into a stipulated agreement dated February 10, 1993, and that neither party intended to attend the hearing.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.
1. The complaint is dismissed.
2. The Commission notes that the parties entered into their stipulated settlement a week before the scheduled hearing in this matter. Although the respondent attempted to notify the Commission of the settlement that was reached by its hand-delivered letter on the morning of the hearing, the courtesy of a simple phone call to the ombudsman in this matter would have avoided the unnecessary travel by and presence of the hearing officer at a hearing neither party planned to attend.
