The above-captioned matter was scheduled to be heard as a contested case on August 12, 1993, at which time the respondent appeared with a witness, but the complainant failed to appear to prosecute his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed with prejudice for failure to prosecute the complaint.
2. The Commission deplores the waste of state and local resources precipitated by the complainant's failure to attend and proceed with the administrative hearing on the complaint. Both the Commission and the respondent were unnecessarily inconvenienced, and the respondent brought counsel at the expense of the taxpayers of the Town of Orange. The Commission condemns the deliberate and inexcusable conduct of Mr. Presnick in this regard.
