The above-captioned matter was heard as a contested
case on March 9, 1995, at which time the respondent appeared. Although the hearing on the matter in this
case had been rescheduled from December 21, 1994 to March 9, 1995 at the
request of and in consideration of the complainant, the complainant failed to
appear on March 9, 1995.
The following order by the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint.
1. The
complaint is hereby dismissed with prejudice for failure to prosecute.
2. The
Commission notes that the unexcused failure of the complainant to appear
resulted in the waste of public resources and reflected poorly on the
complainant.
