The above-captioned matter was heard as a contested case on September 11, 1995, at which time the complainant and the respondent appeared, stipulated to the facts, and presented testimony and exhibits on the complaint.
After consideration of the entire record, the following facts are found and conclusions of law are reached:
1. The respondent is a public agency within the meaning of 1-18a(a), G.S.
2. It is found that by certified letter to the respondent dated December 23, 1994, the complainant requested specific information and/or copies of specified records ("December request").
3. It is found that the respondent received the complainant's December request on December 27, 1994.
4. By letter of complaint dated January 11, 1995, and filed with the Commmission January 17, 1995, the complainant appealed the respondent's failure to respond to, or comply with his December request.
5. By reply letter dated January 17, 1995, the respondent furnished the complainant with some of the requested information, and agreed to enclose copies of training handouts.
6. It is found that by letter dated February 2, 1995, the complainant notified the respondent that the training handouts referenced in the respondent's January letter had not been enclosed.

7. It is found that the records at issue are public records within the meaning of 1-18a(d), G.S.
8. At the hearing on this matter the respondent provided the complainant with copies of all of the additional documents responsive to his records request.
9. The respondent concedes, and it is found, that the requested records were not provided promptly, as required by 1-15 and 1-19(a), G.S.
10. It is therefore concluded that the respondent violated 1-15 and 1-19(a), G.S., by failing to promptly provide the complainant with copies of the requested records.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.
1. Henceforth the respondent shall strictly comply with the disclosure provisions of 1-15 and 1-19(a), G.S.
