The above-captioned matter was heard as a contested
case on August 30, 1995 and December 4, 1995, at which times the complainant
and the respondent appeared and stipulated to certain facts.
After consideration of the entire record, the
following facts are found and conclusions of law are reached:
1. The
respondent is a public agency within the meaning of 1-18a(a), G.S.
2. By letter
dated December 27, 1994, the complainant requested of the respondent access to
inspect all papers and notes pertaining to the promotional examination he took
on December 16, 1993 and copies of same.
3. Having
failed to receive access to the requested materials, the complainant, by letter
dated January 18, 1995, and filed with the Commission on January 23, 1995,
appealed to the Commission alleging that the respondent violated the Freedom of
Information ("FOI") Act by denying him access to the requested
records.
4. The
respondent has possession of the records in question.
The following order by the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint:

1. Based upon
a tender of compliance, in which the respondent has provided access to the
requested records to the complainant, the complaint is hereby dismissed.
