The above-captioned matter was scheduled to be heard as a contested case on January 22, 1997, at which time the respondent appeared, however, the complainant failed to appear to prosecute the complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.
1. The complaint is hereby dismissed.
2. The Commission notes that the complainants failure to appear at the scheduled hearing on this matter is abusive of the Commissions process, a waste of the states limited resources and suggests a lack of respect to the Commission.
Approved by Order of the Freedom of Information Commission at its regular meeting of March 19, 1997.
