The above-captioned matter was heard as a contested case on March 10, 1997, at which time the complainant and the respondent appeared. During a recess of the March 10, 1997 hearing, the complainant and the respondent agreed to attempt with the assistance of the Commission’s ombudsman to reach an agreement in resolution of this contested case. On March 19, 1997, the complainant informed the Commission that he wished to withdraw his complaint.

The Commission warmly commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1. The complaint is hereby dismissed.
