In the Matter of a Complaint by William Choma, Complainant
against
Princess Pocotopaug Association, Respondent

The above-captioned matter was scheduled to be heard as a contested case on June 19, 1997, at which time the complainant and the respondent appeared in order to present testimony and argument on the complaint. During an informal conference at the June 19, 1997 hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case.

The parties agreed that, by oversight, the respondent technically violated the Freedom of Information ("FOI") Act requirements concerning the filing of minutes and that the respondent will comply with the law and spirit of the FOI Act in the future. As a result of this agreement between the parties, the complainant informed the Commission that he wished to withdraw his complaint.

The Commission warmly commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences, and wishes them the benefit of amicable relations with each other in the future.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1. The complaint is hereby dismissed.
