In the Matter of a Complaint by John Schwing and The Fairfield
Minuteman, Complainants
against
Board of Education, Town of Fairfield, Respondent
The above-captioned matter was scheduled to be heard as a contested case on August 1, 1997, at which time the complainants and the respondent appeared in order to present testimony and argument on the complaint.
At an informal conference during the August 1, 1997 hearing, the complainants and the respondent reached the terms of an agreement in resolution of this contested case, wherein the parties agreed that there was a violation of the notice requirement in connection with the respondents special meeting of February 17, 1997, and also that henceforth the respondent will comply with the letter and the spirit of all aspects of the Freedom of Information Act, including with reference to the convening of executive sessions. Based upon this agreement, the complainants informed the Commission that they wished to withdraw their complaint.
The Commission warmly commends both the complainants and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
