In the Matter of a Complaint by John Hallbergh, Jr., Complainant
against
Board of Education, Town of Killingly; and Fiscal Subcommittee, Board of Education, Town of Killingly  Respondents

The above-captioned matter was heard as a contested case on August 27, 1997, at which time the complainant and the respondents appeared and stipulated to the following facts:

1. By letter of complaint dated March 12, 1997, and filed with the Commission on March 14, 1997, the complainant alleged that the respondent board of education held a special meeting on March 4, 1997, regarding adoption of the 1997-98 budget and that the respondent board entered executive session at that meeting for the purpose of discussing possible layoffs. The complainant further alleged that the respondent subcommittee held a meeting on February 20, 1997, at which it went into executive session to discuss personnel matters and that there was no posted agenda for such meeting.

2. The complaint is limited to the matter of the March 4, 1997 meeting of the respondent board.

3. The respondent board met on March 4, 1997, and convened in executive session to discuss personnel matters but did not discuss individuals by name as required by § 1-18a(e)(1), G.S.

4. The complaint may be dismissed on the facts stipulated herein and on the respondents’ promise to abide by the provisions of §§ 1-18a(e)(1) and § 1-21(a), G. S., in the future.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1. The complaint is hereby dismissed.
