        The above-captioned matter was heard as a contested case on December 4, 1997, at which time the complainant and the respondent appeared in order to present testimony, exhibits and argument on the complaint.

        At an informal conference during a recess of the December 4, 1997 hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case. The parties agreed that the respondent will create a single new record disclosing information concerning individuals who received a W-2 for 1996 from certain offices of the Town of New Hartford, as requested by the complainant in his letter to the respondent of June 9, 1997. Specifically, such new record shall include all of the information requested in said June 9, 1997 letter (including full legal names, whether each individual is a part-time or full-time employee, and the job title and date of hire of each individual), except that any date of termination and the complete address of each individual will not be included, but in lieu of the complete address, the number of relevant individuals living in the Town of New Hartford will be disclosed. Such new record will be provided by the respondent to the complainant at no cost to the complainant.

        Based upon this agreement, the complainant informed the Commission that he wished to withdraw his complaint in this matter.

        The Commission warmly commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.
