The above-captioned matter was scheduled to be heard as a contested case on January 21, 1998 at which time the complainant and the respondent appeared in order to present testimony and argument on the complaint.

        At an informal conference prior to the January 21, 1998 hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case. The parties agreed that the respondent expresses regret that the complainant’s September 15, 1997 letter was not acknowledged, that the respondent will furnish the complainant with records relevant to the subject of the complainant’s request which were received by the respondent after September 15, 1997, and that Christopher P. Hankins, Esq. will serve as a liaison between the complainant and the respondent concerning Freedom of Information matters. Based upon this agreement, the complainant informed the Commission that she wished to withdraw her complaint.

        The Commission warmly commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.
