The above-captioned matter was scheduled to be heard as a contested case on March 16, 1998, at which time the complainant and the respondents appeared in order to present testimony and argument on the complaint.
At an informal conference prior to the March 16, 1998 hearing, the complainant and the respondents reached the terms of an agreement in resolution of this contested case, wherein the parties agreed that the respondent commission would hold regular office hours, initially on Tuesdays from 8 A.M. to 3 P.M.; that the regular office hours and meeting times of the respondent commission would be posted in a visible place; that the answering machine of the respondent commission would be maintained in good repair and the bell at the front door will be made to sound in the secretarys office; that, if the secretary, the Fire Chief or respondent Chairman is in the fire house, the complainant would be allowed access to the records of the respondent commission; and finally, that the complainant can call the respondent Chairman at his home in order to arrange access to the records of the respondent commission. Based upon this agreement, the complainant informed the Commission that he wished to withdraw his complaint in the above captioned matter and also in Docket #FIC 1998-034.
The Commission warmly commends both the complainant and the respondents for working successfully to negotiate a non-litigated settlement of their earlier differences.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
