The above-captioned matter was scheduled to be heard as a contested case on May 
6, 1998, at which time the respondent appeared in order to present testimony and 
argument on the complaint. The complainant was reached by telephone and took part in 
the proceedings by speaker phone.

	At an informal conference prior to the May 6, 1998 hearing, the complainant and 
the respondent reached the terms of an agreement in resolution of this contested case. 
Counsel for the respondent represented to the Commission that neither the respondent nor 
attorney Rich Mills, in his capacity as an attorney for the Board of Education of the Town 
of Orange, are in possession of the transcript requested by the complainant on April 28, 
1997. Based upon this representation, the complainant informed the Commission that he 
wished to withdraw his complaint.

	The Commission warmly commends both the complainant and the respondent for 
working successfully to negotiate a non-litigated settlement of their earlier differences.

	The following order by the Commission is hereby recommended on the basis of 
the record concerning the above-captioned complaint:

	1.  The complaint is hereby dismissed.

	Approved by Order of the Freedom of Information Commission at its regular 
meeting of May 27, 1998.
