The above-captioned matter was scheduled to be heard as a contested case on May 14, 1998, at which time the complainants indicated that they are not claiming that the respondent violated the Freedom of Information Act but instead are seeking guidance regarding the difference between disciplinary and administrative hearings. At an informal conference the complainants and the respondent reached the terms of an agreement in resolution of the complaint, whereby the respondent agreed to provide the complainants with a copy of a recent Connecticut Appellate Court decision which appears to address the issues of concern to the complainants. Based on the agreement reached by the parties, the complainants informed the Commission that they wished to withdraw the complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
2. The Commission commends the parties on having been able to successfully resolve their differences.
