The above-captioned matter was scheduled to be heard as a contested case on May 19, 1998, at which time the complainant and the respondent appeared in order to present testimony and argument on the complaint.
After having received the sworn testimony of the respondent that the requested tape was no longer in existence, the complainant informed the Commission that he wished to withdraw his complaint.
The Commission commends the parties, and especially the complainant, for taking the steps necessary to achieve a non-litigated settlement of earlier differences.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed without prejudice.
