The above-captioned matter was heard as a contested case on June 2, 1998, at which time the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint. At the conclusion of the June 2, 1998 hearing, the hearing officer requested that the complainant submit to the Commission within seven days a copy of the report at issue in its redacted form, with red check marks added next to each redacted item that the complainant claimed to be subject to disclosure. The hearing officer also ordered the respondents to submit subsequently an unredacted copy of the relevant report for an in camera inspection, together with the required index indicating the claims of exemptions for each item which the complainant had claimed to be subject to disclosure.
When the complainant failed to make the submission requested of her, the hearing officer on July 2, 1998 ordered both parties to file the relevant records with the Commission, on July 16, 1998 and July 30, 1998, respectively, and stated that failure of the complainant to make the first filing ordered may result in dismissal for failure to prosecute.
The complainant still has not filed with the Commission the marked report first requested on June 2, 1998 and then, on July 2, 1998, ordered to be filed by July 16, 1998.
Therefore, the following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed for failure to prosecute. Approved by Order of the Freedom of Information Commission at its regular meeting of October 28, 1998.
