The above-captioned matter was scheduled to be
heard as a contested case on December 28, 1998 at which time the parties appeared and
agreed to the following in resolution of the complaint:
1. With respect to the allegations pertaining to contested case docket #FIC 1997-302, George W. Sicaras v. Ray Harasymiw, Director, Department of Finance, City of Hartford; and Department of Finance, City of Hartford,
a. the respondents agreed to review the records of the City of Hartford ("city") Department of Finance in an attempt to locate the invoice reflecting the amount paid by the city for Chief Joseph Croughwells photograph, and if necessary, the respondents will request a copy of the invoice from the citys police department or the photographer, and provide the complainant with a copy of the invoice if located.
b. If the respondents are unable to locate the invoice, described in a) above, the respondents will provide the complainant with an affidavit, attesting to the fact that they conducted a detailed search of their records and that no invoice exists in their files.
2. With respect to the allegations pertaining to contested case docket #FIC 1997-303, George W. Sicaras v. Denise Nappier, Treasurer, City of Hartford; and City of Hartford,
a. the respondents agreed to review their records and to provide the complainant with records of the complainants total earnings and high average earnings for the years 1981, 1982 and 1983 and specifically, those records that show how the citys March 15, 1994 final benefits calculation for the complainant was arrived at.
b. the respondents further agreed to consult with the citys pension commission to ascertain whether such commission has any opinions of corporation counsel concerning the citys pension policies. If the pension commission has such records, the respondents will provide the complainant with a copy of same. If the pension commission does not have the opinions, the respondents will review the files of the corporation counsel, and will provide the complainant with those opinions concerning the citys pension policies.
Based on the foregoing, the complainant withdrew his complaint.
The following order by the Commission is
hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed.
