The above-captioned matter was scheduled to be heard as a contested case on January 11, 1999, at which time the complainant and the respondent reached the following terms of an agreement in resolution of this contested case.
1) The parties agreed that the respondent violated the Freedom of Information Act during its November 10, 1998, meeting, as alleged in the complaint in this matter, which was filed November 18, 1998 with the Commission.
2) The respondent shall promptly provide the complainant with a formal, written apology for such violation.
3) The respondent shall promptly contact the Commissions Director of Education in order to schedule a workshop on the Freedom of Information Act.
Based upon this agreement, the complainant informed the Commission that he wished to withdraw his complaint in this matter.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
