The above-captioned matter was heard as a contested case on April 14, 1999, at which time the complainants and the respondent appeared, and presented testimony and argument on the complaint.
Following a recess of the April 14, 1999 hearing, the complainants informed the Commission that, based upon the evidence presented under oath concerning a private meeting on February 12, 1999, they wished to withdraw their complaint.
The Commission warmly commends the complainants for proceeding with good judgment as the case developed and notes that the complaint filed was not frivolous in nature.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
