The above-captioned matter was scheduled to be heard as a contested case on July 21, 1999, at which time the complainant and the respondents appeared in order to present testimony and argument on the complaint.
At an informal conference prior to the July 21, 1999 hearing, the complainant and the respondents reached the terms of an agreement in resolution of this contested case. The parties agreed that there was a technical deficiency in the Incident Summary furnished to the complainant in that it stated the time and date of the incident that was the basis for the arrest, rather than the time and date of the arrest itself, as required by § 1-215(b)(1), G.S. Based upon this agreement, the complainant informed the Commission that she wished to withdraw her complaint.
The Commission warmly commends both the complainant and the respondents for working successfully to negotiate a non-litigated settlement of their earlier differences.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
