The caption above has been amended and restated in order to reflect the granting of party status to the Protective Services Employees Coalition. The matter was scheduled to be heard as a contested case on July 29, 1998, at which time the complainants and the respondents appeared in order to present testimony and argument on the complaint.
At an informal conference prior to the July 29, 1999 hearing, the complainants and the respondents reached the terms of an agreement in resolution of this contested case. The University respondents agreed to furnish to the complainants, within two weeks, copies of the employment applications for dispatchers and Sergeants as requested, but with the following information redacted for employment applicants and references residing at the same address as employment applicants: residential address, residential telephone number and social security number. Moreover, this agreement is without prejudice to the claims of exemption of respondent Protective Services Employees Coalition concerning other pre-employment records, not subject to the request and complaint herein, but which are required by the Police Officers Standards and Training Council (such as, for example, the results of polygraph and psychological examinations). Based upon this agreement, the complainants informed the Commission that they wished to withdraw their complaint.
The Commission warmly commends both the complainants and the respondents for working successfully to negotiate a non-litigated settlement of their earlier differences.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
