The
above-captioned matter was scheduled to be heard as a contested case on July 8,
1999, at which time the complainant and the respondents appeared in order to
present testimony and argument on the complaint. At an informal conference
prior to the July 8, 1999 hearing, the respondents provided additional records
to the complainant for his review.
No withdrawal was received
following an opportunity for the complainant to review the records provided on
July 8, 1999, and an opportunity to review as well other records within the
custody of the respondents concerning First Step, Inc., which may not have been
within the terms of the complainants’ original request. Accordingly, the
above-captioned matter was scheduled for a continued hearing to be held on
September 16, 1999. At that time, the respondents appeared but the complainant
failed to appear. While a full evidentiary record has, therefore, not been
compiled in this case, the Commission notes the substantial efforts that the
respondents have made to satisfy their legal obligations pursuant to the
Freedom of Information Act.
The
following order by the Commission is hereby recommended on the basis of the
record concerning the above-captioned complaint:
1. The complaint is hereby dismissed for
failure to prosecute.
