The above-captioned matter was scheduled to be heard as a contested case on November 5, 1999, at which time the complainant and the respondent appeared and began to present testimony and argument on the complaint.
However, at an informal conference during the November 5, 1999 hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case, wherein the respondent agreed to furnish to the complainant, at no cost to the complainant, a copy of the computer print-out of lottery tickets sold at terminal #1676 on March 28, 1998. Based upon this agreement, the complainant informed the Commission that he wished to withdraw his complaint.
The Commission warmly commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
