            The above-captioned matter was scheduled to be heard as a contested case on February 17, 2000 at 10:00 A.M., at which time the respondent appeared but the complainant did not.   

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is hereby dismissed.

 

            2.   The Commission wishes to admonish the complainant for his failure to appear at the hearing in this matter, which failure resulted in a waste of the scarce resources of this Commission, as well as the time and effort of the respondent.   Moreover, the Commission wishes to remind the complainant that, pursuant to §1-206(b)(2),G.S. [formerly §1-21i(b)(2), G.S.], if it finds that a person has taken an appeal frivolously, without reasonable grounds and solely for the purpose of harassing the agency from which the appeal has been taken, it may, after providing the person with an opportunity to be heard, impose against such person a civil penalty of not less than twenty dollars nor more than one thousand dollars. 

 

3.  The Commission shall take administrative notice of the final decision in this matter in the event that the complainant files subsequent complaints.
