            The above-captioned matter was scheduled to be heard as a contested case on February 24, 2000, at which time the complainant and respondents appeared and reached the following terms, in resolution of this case:

 

1.  By February 29, 2000, the respondents shall make available to the complainant all records described in the complainant’s request for records dated December 17, 1999, except as described in paragraph 2, below.  The respondents shall provide copies of such records requested by the complainant on or soon after February 29, 2000.

 

2.  With respect to the enforcement records described in the first bullet on page one of the complainant’s December 17, 1999, request, the complainant shall provide the respondents with a list of requested enforcement files, containing the dates of such files, by March 3, 2000.  Thereafter, the respondents shall screen such requested records for privileged information, redact any such privileged information, and make available such records, in redacted form, to the complainant on or before March 17, 2000. The respondents shall provide copies of such records requested by the complainant on or soon after March 17, 2000.

 

3.   With respect to future freedom of information requests, the complainant shall submit such requests to Dean Applefield, a DEP employee, who shall work in cooperation with the complainant in attempting to fulfill such requests and who shall communicate to the complainant information related to the volume of records and search time involved in complying with such future requests.    

 

4.  In consideration of the foregoing, the complainant withdrew the complaint in this

 matter. 

 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.

 

            2.  The Commission commends all parties for reaching a non-litigated settlement of this matter.
