The above-captioned matter was scheduled to be heard
as a contested case on March 17, 2000, at which time the complainant and the
respondent appeared and resolved the complaint, following which the
complainant withdrew the complaint. The
following are the terms of such agreement:
Regarding the oral interview for the position of
lieutenant, the respondent has agreed to provide the complainant with: the
scoring sheets for each successful candidate with the question numbers
redacted from each scoring sheet; a computer printout with the successful
candidates number, name and total raw oral score; and a list of the panelists
identified by name, assigned panel number and their individual number.
Further, the complainant will provide the respondent
with written authorization from any unsuccessful candidates at which time the
respondent will provide all of the information with respect to such candidates
that will be provided with respect to the successful candidates.
The
following order by the Commission is hereby recommended on the basis of the
record concerning the above-captioned complaint.
1. The complaint is hereby dismissed.
