The above-captioned matter was heard as a contested case on September 7, 2000, at which time the complainants and the respondent appeared, and presented testimony, exhibits and argument on the complaint. Pursuant to §1-206(b)(1), G.S., Janet Groeper an employee of the city of Middletown whose personnel file records are at issue, was granted party status in this matter. The settlement agreement at issue was reviewed in camera.
Following the hearing in this matter, the Hearing Officer issued a Hearing Officer Report dated January 26, 2001, which was scheduled to be considered by the Commission at its regular meeting of February 28, 2001.
However, by letter dated February 16, 2001 and filed with the Commission on February 20, 2001, counsel for the complainants informed the Commission that the parties in this matter had arrived at a settlement in resolution of their dispute, and that the complainants are therefore withdrawing the complaint.
The Hearing Officer hereby withdraws the January 26, 2001 Hearing Officer Report and substitutes this report in lieu thereof and in resolution of the complaint in this matter.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
