The above-captioned matter was heard as a contested case on October 30, 2000, at which time the complainant appeared, and presented testimony, exhibits and argument on the complaint. The respondent failed to appear. A continued hearing was held on February 16, 2001, at which time the complainant and the respondent appeared, and presented exhibits and argument on the complaint. At such continued hearing, Officer Louis Cavalier, Officer A. Maio, Officer D. Runlett, Officer D. Cargil, and Officer William Coppola, appeared, and requested, and were granted, party status.
At the February 16, 2001 hearing in this matter, the parties reached the terms of an agreement in settlement of the complaint. Specifically, the respondent agreed to provide the complainant with copies of the personnel files of Sgt. Edward Kendall, Officer Louis Cavalier, Officer A. Maio, Officer D. Runlett, Officer Kasperzyk, Officer D. Cargil, Detective Edwin Rodriguez, Officer William Coppola and Sgt. Bryan Norwood, excepting social security numbers, medical records, and records related to the personal lives of such officers, after the subjects of such files reviewed their individual files. In consideration of this agreement, the complainant agreed to withdraw his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
2. The parties are commended for reaching a non-litigated settlement of this matter.
