The above-captioned matter was scheduled to be heard as a contested case on February 13, 2001, at which time the complainants and the respondents appeared and indicated to the Hearing Officer that they reached a settlement in resolution of the complaint.  Specifically, with respect to the complainants’ records request dated January 2, 2001, the respondents agreed to permit the complainants access to the following by early March 2001:  a) the mayoral schedule for the 2000 calendar year and b) all correspondence regarding minor league baseball and stadium plans.  The respondents further agreed to permit the complainants access to future schedules of the mayor, and to implement a system whereby the complainants’ FOI requests are streamlined and dealt with in a punctual manner.  The complainants agreed to not pursue the third item requested in their letter of request dated January 2, 2001.

 

            In light of the above, the complainants further agreed to withdraw the complaint.

           

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.   The complaint is hereby dismissed.

 

            2.  The Commission commends the parties on having settled their differences without the need for a formal hearing.
