Pursuant to a June 13, 2001 vote of the Freedom of Information Commission, the final decision in the above-captioned matter was set aside and such matter was reopened. On August 30, 2001, the parties were directed to file briefs on the issue of the applicability of the Supreme Court decision in Rocque v. Freedom of Information Commission, 255 Conn. 651 (2001) to this case, and to make any motion for a further evidentiary proceeding, by September 28, 2001.
The respondents and intervener filed such brief with the Commission on September 28, 2001. The complainants have not filed a brief.
The following order by the Commission is hereby recommended on the
basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
