The above-captioned matter was heard as a contested case on May 11, 2001.
At the hearing, the complainants and the respondents commissioner and
department appeared, stipulated to certain facts, and presented testimony,
exhibits and argument on the complaint. During
the hearing, the Hearing Officer determined that South Hartford
Initiative (hereinafter “SHI”) was a necessary party for the proper
disposition of this case and added SHI as a party respondent.
The Hearing Officer continued the hearing to June 18, 2001, at
which time the respondents commissioner, department, and SHI appeared,
however, the complainants failed to appear.
The Hearing Officer further continued the June 18, 2001 hearing
to August 31, 2001, at which time the
complainants, and the respondents commissioner, department, and SHI appeared and informed the Commission that the parties were in the
process of trying to resolve the complaint and that a further continuance was
being jointly requested to allow them to pursue settling this matter.
Thereafter, by letter dated and filed with the Commission on October
25, 2001, the complainants informed the Commission that they were withdrawing
the complaint.
Based upon the foregoing, the following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
2. The Commission commends the parties for their efforts in resolving this matter.
