The above-captioned matter was scheduled to be heard as a contested case on April 29, 2002, at which time the complainant and the respondent appeared in order to present testimony, exhibits and argument on the complaint. At an informal conference prior to the hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case. The parties agreed that:
a) the East Hartford Public Schools reaffirms its commitment to provide records promptly in response to Freedom of Information Act requests in the future;
and based upon this undertaking, that
b) the complainant wishes to withdraw her complaint in this matter.
The Commission warmly commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences. The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
