The above-captioned matter was heard as a contested case on August 16, 2001, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. 

           

After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

1.  The respondents are public agencies within the meaning of §1-200(1), G.S.

 

2.  It is found that the complainant is a union steward for AFSCME Local 1565, the collective bargaining representative for certain employees of the respondent department.

 

3.  It is found that, by letter dated May 29, 2001, the complainant requested that the respondents provide him with copies of

 

a.       videotapes used as evidence against corrections officers Parks and DeVito in their dismissal from the respondent department at Corrigan Correctional Institution on November 9, 2000 between the hours of 8A.M. and 4 P.M., including the incident in a certain cell; and

b.      the chain of custody record for such evidence and a copy of the log recording the names of all persons who viewed such videotapes. 

 

4.  It is found that, by letter dated June 6, 2001, the respondents acknowledged receipt of the request described in paragraph 3, above.

 

5.  It is found that, by letter dated June 23, 2001, the complainant requested that the respondents provide him with copies of:

 

a.       all interview notes of the actual statements made by and the time of the interview on March 26, 2001 at the Loudermill proceedings for officers Parks and DeVito;

b.      page 3 of the code white captain’s report;

c.       page 24 of the facility incident report; and

d.      the incident report of Lt. Sorenson in its entirety.

 

6.  It is found that, by letter dated June 25, 2001, the respondents informed the complainant that he was denied the records requested as described in paragraph 5, above, under the Freedom of Information [hereinafter “FOI”] Act, but that he may be at liberty to review such materials in his capacity as union steward.

 

7.  It is found that, by letter dated June 27, 2001, the complainant requested that the respondents provide him with copies of:

                                                                                                 

a.       the state police report related to the incident of November 9, 2000; and

b.      page 2 of the facility incident report described in paragraph 5, above. 

 

It is also found that, by such letter, the complainant renewed his request for page 24, and for Lt. Sorenson’s report, as described in paragraph 5, above.

 

8.  It is found that, by letter dated June 29, 2001, the respondents acknowledged receipt of the request described in paragraph 7, above.

 

9.  It is found that, by letter dated July 3, 2001, the respondents asked the complainant to inform them as to who provided him with the documents from which pages were missing, since such information would be helpful to them in obtaining the missing pages.  It is also found that, by such letter, the respondents denied the complainant a copy of the state police report requested as described in paragraph 7, above.  It is further found that the complainant did not respond to the respondents’ request for information described in this paragraph.

 

10.  By letter dated July 5, 2001, and filed with the Commission on July 9, 2001, the complainant appealed to the Commission, alleging that the respondents violated the FOI Act by denying him copies of the records described in paragraphs 3.a, 3.b, 5.a, 5.c, 5.d, 7.a, and 7.b, above. 

 

11.  It is found that, to the extent that they exist, the requested records are public records within the meaning of §1-210(a), G.S.

 

            12.  Section 1-210(a), G.S., provides in relevant part that “[e]xcept as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency…shall be public records and every person shall have the right to inspect such records promptly during regular office or business hours or to receive a copy of such records….”

 

13.  Section 1-212(a), G.S., provides in relevant part that “[a]ny person applying in writing shall receive, promptly upon request, a plain or certified copy of any public record.”

 

14.  It is found that the complainant was able to view a videotape which he requested in July 2001, in his capacity as union steward, but that he did not receive a copy of such tape.

 

15.  It is also found that, by letter dated August 14, 2001, the respondents informed the complainant that the requested videotapes, chain of custody record and logs, as described in paragraphs 3.a and 3.b, above, were available for his inspection as union steward but that they were exempt from disclosure under the FOI Act due to issues of security, that the state police report must be obtained from the state police, that Lt. Sorenson did not create a report, that the handwritten Loudermill notes were exempt as preliminary drafts, but that he was provided with the final typed report of the Loudermill proceedings.  In addition, it is found that, by such letter, the respondents provided the complainant with copies of the records described in paragraphs 5.c and 7.b, above.

 

16.  It is further found that the respondents provided the complainant with a copy of the state police report described in paragraph 7.a, above, at a labor board hearing several weeks after the complainant requested such record.  At the hearing in this matter, the respondents stipulated that they had not been prompt in providing a copy of such record.

 

17.  It is further found that the provision of the records described in paragraphs 5.c, 7.a and 7.b, above, as described in paragraphs 15 and 16, above, was not prompt within the meaning of §1-212(a), G.S.  Accordingly, it is concluded that the respondents violated that provision of the FOI Act with respect to such records.

 

18.  It is further found that Lt. Sorenson did not create an incident report, as described in paragraph 5.d, above.  Therefore, it is concluded that the respondents did not violate the FOI Act by failing to provide a copy of such record to the complainant.

 

19.  The respondents contend that the requested videotapes, chain of custody records and logs, as described in paragraphs 3.a and 3.b, above, are exempt from disclosure pursuant to §1-210(b)(18), G.S.

 

20.  Section 1-210(b)(18), G.S., exempts from mandatory disclosure:

                       

[r]ecords, the disclosure of which the Commissioner of Correction has reasonable grounds to believe may result in a safety risk, including the risk of harm to any person or the risk of an escape from, or a disorder in, a correctional institution or facility under the supervision of the Department of Correction….

 

21.  It is found that release of the videotapes described in paragraph 3.a, above, would reveal the configuration of a correctional facility and that, as such, the respondent commissioner has reasonable grounds to believe that disclosure of such records may result in a safety risk, within the meaning of §1-210(b)(18), G.S.  Accordingly, it is concluded that the respondents did not violate the FOI Act by denying the complainant a copy of such records.

 

22.  It is further found, however, that the respondents failed to prove that the respondent commissioner has reasonable grounds to believe that disclosure of the chain of custody records and log described in paragraph 3.b, above, may result in a safety risk within the meaning of §1-210(b)(18), G.S. 

 

23.  At the hearing in this matter, the respondents also contended that the records described in paragraph 3.b, above, as well as the records described in paragraph 5.a, above, were exempt from mandatory disclosure by virtue of  §1-210(b)(2), G.S.  

 

24.  Section 1-210(b)(2), G.S. in relevant part provides for the nondisclosure of "personnel or medical files and similar files the disclosure of which would constitute an invasion of personal privacy."

 

            25.  The Supreme Court set forth the test for the §1-210(b)(2), G.S., exemption in Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993), which test has been the standard for disclosure of records pursuant to that exemption since 1993.  The Commission takes administrative notice of the multitude of court rulings, Commission final decisions,1 and instances of advice given by Commission staff members,2 which have relied upon the Perkins test, since its release in 1993.

 

26.  Specifically, under the Perkins test, the claimant must first establish that the files in question are personnel, medical or similar files.  Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy.  In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: first, that the information sought does not pertain to legitimate matters of public concern, and second, that such disclosure of such information is highly offensive to a reasonable person.

 

            27.  It is found that the respondents failed to prove that the chain of custody records and logs, described in paragraph 3.b, above, are personnel or medical and similar files within the meaning of §1-210(b)(2), G.S.  Accordingly, it is concluded that such records are not exempt from mandatory disclosure by virtue of such provision.  It is further concluded that the respondents violated the FOI Act by failing to provide the complainant with a copy of such records, as alleged in the complaint.

 

28.  With respect to the records described in paragraph 5.a, above, it is found that such record is not a personnel, medical or similar file within the meaning of §1-210(b)(2), G.S., and not meant to become part of any such file.  They are rather the notes of a labor relations proceeding.  Consequently, it is concluded that such record is not exempt from disclosure under §1-210(b)(2), G.S.

 

29.  At the hearing in this matter, the respondents stated that they would provide the complainant with copies of such records if the complainant would provide them with copies of releases signed by officers Parks and DeVito.   

 

30.  Section 1-214(b), G.S., in relevant part states:

 

“[w]henever a public agency receives a request to inspect or copy records contained in any of its employees' personnel or medical files and similar files and the agency reasonably believes that the disclosure of such records would legally constitute an invasion of privacy, the agency shall immediately notify in writing (1) each employee concerned, provided such notice shall not be required to be in writing where impractical due to the large number of employees concerned and (2) the collective bargaining representative, if any, of each employee concerned….”                                             

                                                                                               

31.  Section 1-214(c), G.S., in relevant part states:

 

“[a] public agency which has provided notice under subsection (b) of this section shall disclose the records requested unless it receives a written objection from the employee concerned…Upon the filing of an objection as provided in this subsection, the agency shall not disclose the requested records unless ordered to do so by the Freedom of Information Commission pursuant to section 1-206….” 

 

32.  It is found that although the respondents failed to notify the subjects of the records requested in paragraph 5.a, above, officers Parks and DeVito, pursuant to the requirements of §§1-214(b) and (c), G.S., about the request for such records, those individuals had actual notice of the request because it was made by their collective bargaining representative inferentially on their behalf.  Therefore, it is found that such officers had the opportunity to object to such disclosure and chose not to do so.  In light of these findings, it is concluded that there is no legal basis for the respondents to condition disclosure of the records at issue upon the presentation of a release by the officers in question.  

 

            33.  The respondents also previously contended that the records described in paragraph 5.a, above, were exempt from mandatory disclosure by virtue of §1-210(b)(1), G.S., although such contention was not argued at the hearing in this matter. 

 

34.  Section 1-210(b)(1), G.S., exempts from mandatory disclosure “preliminary drafts or notes provided the public agency has determined that the public interest in withholding such documents clearly outweighs the public interest in disclosure...”

 

35.  It is found that the respondents failed to prove that they had determined that the public interest in withholding the records described in paragraph 5.a, above, clearly outweighs the public interest in disclosure of such records.  Accordingly, it is concluded that such records are not exempt by virtue of §1-210(b)(1), G.S. in this case. 

 

 The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

            1.  Forthwith, the respondent shall provide the complainant with copies of the chain of custody records and log, and interview notes, described in paragraphs 3.b and 5.a of the findings, above.

AFFIDAVIT OF ERIC V. TURNER

 

Eric V. Turner, having been duly sworn, does hereby depose as follows:

 

1.  I am over the age of eighteen (18) years and understand the obligation of an affirmation.

 

2.  I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.

 

3.  I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993).  See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).

 

4.  As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.

 

5.  Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.

 

6.  As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra.  See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.

 

7.  Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.

 

8.  As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public.  Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption.  In responding to such inquiries I discuss in detail the Perkins case and its progeny.

 

9.  Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information.  Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.
